This Workshop will review the tests traditionally used to distinguish between Employees and Independent Contractors, why the distinction is important, how the test process was changed by the Dynamex case and Assembly Bill 5. The presenters will discuss the exceptions to AB5 and the consequence of such exceptions. The many ambiguities and questions raised by this legislation will be examined. The presenters will discuss the intended and unintended consequences and the penalties for non-compliance will be outlined. This workshop is will be presented by attorneys Jackie McClain, CSU Vice Chancellor Emerita Human Resources and James Morgan, Professor of Legal Studies, CSU Chico.
